Please read these Terms of Use before using genniemac.com (the “Site”). By accessing or using the Site, you agree to these terms. If you do not agree, do not use the Site.
Who we are
GennieMac® Capital is the commercial and specialized lending arm of GennieMac® [GNMC]. The licensed company’s legal name appears in the Site footer: GenerationNext Equity Management Company, LLC. GennieMac® Capital is a DBA of GenerationNext Equity Management Company, LLC. Company NMLS ID #2326098. Delaware file #6596660. Registered office: 16192 Coastal Highway, Lewes, DE 19958. We originate and/or arrange financing; we are not a bank or credit union.
This Site describes commercial real estate, business-purpose, and specialized lending only. It is not a consumer residential mortgage website. Owner-occupied and consumer home loans are originated only through GenNext.Mortgage® [NMLS 2326098].
Not a commitment to lend
Nothing on this Site is a commitment to lend, a guarantee of approval, speed, or closing date, an offer of specific credit terms, or a consumer credit advertisement. Any LTV, DSCR, rate, term, timeline, or size figure is illustrative only, may change, and is available only on qualifying files where a lender actually offers that structure. All financing is subject to credit approval, underwriting, collateral, occupancy and use of proceeds, licensing, and applicable law. A third-party lender typically funds an approved file.
Submitting a scenario on this Site is not a loan application under applicable law and does not start a consumer mortgage application. If a complete application is taken, required disclosures will be provided at that time.
Licensing and where we operate
We originate or arrange financing only where licensed or exempt. Products are not available in all states. State licenses currently include:

Confirm current licensing on NMLS Consumer Access. Individual NMLS unique identifiers appear on Our Team for licensed originators, as required by the SAFE Act and state mortgage advertising rules.
Information, products, or services on this Site are not a solicitation in any jurisdiction where that activity is not permitted. You are responsible for complying with local law.
Accuracy and changes
We try to keep the Site accurate. It may contain typographical, technical, or factual errors, and content may become outdated. We do not warrant that the Site is complete, current, or error-free, and we may change or discontinue programs, content, or access without notice.
Intellectual property
The Site and its text, graphics, logos, marks (including Gennie Mac® and GennieMac® Capital), and software are owned by us or our licensors and protected by U.S. and international intellectual-property laws. You may view and print pages for your own non-commercial use. You may not copy, scrape, resell, or commercially exploit the Site without our written consent.
Acceptable use
You agree not to use the Site to submit false information; attempt to gain unauthorized access; interfere with security or operations; or post unlawful, defamatory, or infringing content. We may deny or terminate access at any time.
Third-party sites
The Site may link to GenNext.Mortgage® [NMLS 2326098], NMLS Consumer Access, lenders, social media, or other third parties. Links are for convenience and are not an endorsement. Their terms and privacy practices apply when you leave this Site.
Telephone, email, and SMS
If you provide a phone number and consent on a form, you authorize GennieMac® Capital and persons acting for us to contact you by call, email, or text (SMS) about your commercial or specialized lending inquiry, including status, information requests, and closing coordination. Consent is not a condition of submitting a scenario or of obtaining financing. Message frequency varies. Message and data rates may apply. Reply STOP to cancel texts, or HELP for help. You may also call (978) 705-1002 or email Advisors@GennieMac.com. Cancellation takes effect after we have a reasonable time to process it.
Your information
Information you submit is handled as described in our Privacy Policy. You represent that information you provide is accurate and that you are authorized to submit it.
Availability
The Site may be unavailable because of maintenance, outages, or factors outside our control. Access to the internet, hardware, and software needed to use the Site is your responsibility. We are not liable for unavailability or for damage from viruses or other harmful code, to the fullest extent permitted by law.
Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS, ARISING FROM THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.
Indemnity
You will indemnify and hold us harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your content, or your violation of these terms or applicable law.

References to SBA 7(a) or 504 describe structures that may be available through participating lenders. GennieMac® Capital is not the U.S. Small Business Administration, is not a government agency, and is not endorsed by SBA.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where federal law (including the SAFE Act and other federal financial laws) controls. If a provision is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver.
Changes
We may update these terms. The “Last updated” date will change. Continued use of the Site after a change means you accept the revised terms. Review this page periodically.
